Oprichter Samourai Wallet Vrijgelaten op Borgtocht: Wat Nu?
William Lonergan Hill, medeoprichter van Samourai Wallet, werd in april samen met Keonne Rodriguez gearresteerd op beschuldiging van witwassen en het runnen van een ongeregistreerd geldtransmissiebedrijf. Hill is nu op borgtocht vrijgelaten, al moeten de details nog worden uitgewerkt.
Waar Mag Hill Zijn Tijd Doorbrengen?
Er is onenigheid over waar Hill zijn tijd in afwachting van de rechtszaak moet doorbrengen. Zijn verdediging wil dat de 65-jarige ontwikkelaar, die van Brooklyn naar Parijs en vervolgens naar Portugal verhuisde, bij zijn vrouw in Portugal blijft. De aanklagers willen echter dat hij in de kelder van zijn zus in Brooklyn verblijft. Rodriguez, die onschuldig pleitte, werd al vrijgelaten op een borg van $1 miljoen. Hill’s borgtocht bedraagt minstens $3 miljoen en kan oplopen tot $4,4 miljoen als hij in Portugal mag blijven.
Hill Vecht de Aanklachten Aan
Net als Rodriguez, is Hill van plan de aanklachten aan te vechten. Zijn advocaat verwacht dat het proces pas diep in 2025 zal plaatsvinden vanwege de grote hoeveelheid bewijsmateriaal en pre-trial acties. In de verdediging worden verschillende argumenten aangedragen, waaronder dat Samourai Wallet jarenlang in de Google App Store stond. Dit zou volgens de verdediging betekenen dat Google medeplichtig zou zijn als de app inderdaad voor witwassen bedoeld was.
De verdediging stelt ook dat de aanklacht van samenzwering om te witwassen afhangt van de aanklacht dat Samourai Wallet een ongeregistreerd geldtransmissiebedrijf was, wat in strijd zou zijn met de richtlijnen van FinCEN. Als de wallet geen geldtransmissiebedrijf was, had het geen verplichtingen onder de Bank Secrecy Act.
Steun uit de Politiek
Senatoren Cynthia Lummis en Ron Wyden hebben procureur-generaal Merrick Garland geschreven dat het vervolgen van ontwikkelaars van non-custodial crypto-software innovaties zal belemmeren en het vertrouwen in de rechtsstaat zal ondermijnen.
Wat Staat Er Te Gebeuren?
Hill moet op 9 of 10 juli voor de eerste keer verschijnen in de U.S. District Court for the Southern District of New York. Het belooft een langdurige rechtszaak te worden, waarbij de uitkomst onduidelijk is.
