Atomic Wallet wint rechtszaak over $100M hack
Een Amerikaanse rechter heeft de rechtszaak tegen Atomic Wallet afgewezen, omdat het hof geen jurisdictie had over het Estse bedrijf.
Op 10 september oordeelde een federale rechter in Colorado dat de rechtbank geen rechtsbevoegdheid had om de zaak tegen Atomic Wallet, CEO Konstantin Gladyshev, aandeelhouder Pavel Sokolov en softwareontwikkelingsbedrijf Evercode Infinite te behandelen. De rechtszaak was aangespannen door gebruikers van Atomic Wallet, nadat de wallet in juni slachtoffer was geworden van een hack ter waarde van 100 miljoen dollar.
De rechter verklaarde dat de banden tussen Atomic Wallet en de staat Colorado niet sterk genoeg waren om jurisdictie vast te stellen. Atomic Wallet had al in november 2023 een verzoek ingediend om de zaak te laten seponeren, waarbij werd aangevoerd dat het bedrijf geen banden met de Verenigde Staten had. Van de 21 eisers woonde alleen Graham Dickinson in Colorado, de staat waar de rechtszaak werd aangespannen.
De eisers beweerden dat de advertenties van Atomic Wallet zichtbaar waren in Colorado via X en dat de mobiele app daar kon worden gedownload. Daarnaast beweerden ze dat Dickinson regelmatig contact had met de klantenservice van Atomic Wallet. De rechter stelde echter dat het digitale product van Atomic Wallet overal ter wereld gedownload kon worden, zonder dat het bedrijf wist waar de gebruikers zich bevonden.
De rechter gaf de eisers nog 21 dagen om een verklaring te geven waarom Ilia Brusov, mede-oprichter van Evercode Infinite en aandeelhouder van Atomic Wallet, niet uit de zaak zou moeten worden verwijderd. Brusov bezit, net als Sokolov, een belang van 12,8% in Atomic Wallet, terwijl Gladyshev de resterende 74,4% van de aandelen in handen heeft.
