India overweegt nieuwe kansen voor buitenlandse crypto-exchanges
India’s Financial Intelligence Unit (FIU) kijkt opnieuw naar de aanvragen van vier buitenlandse crypto-exchanges die eerder waren verboden vanwege het niet naleven van de anti-witwaswetgeving (AML). Naar verwachting zullen minstens twee van deze exchanges binnenkort weer de Indiase markt mogen betreden.
Heropening voor buitenlandse exchanges Na de goedkeuring van Binance en KuCoin door de FIU, hebben vier andere buitenlandse crypto-exchanges hun aanvragen ingediend. De verwachting is dat twee daarvan tegen eind 2025 weer actief mogen worden in India, mits ze voldoen aan strikte eisen zoals transparante transacties en het rapporteren van verdachte activiteiten.
Eerder blokkeerde de FIU de toegang tot negen buitenlandse crypto-exchanges, waaronder Binance, vanwege schendingen van de AML-regels. Inmiddels heeft Binance een boete van $2 miljoen betaald en zich opnieuw geregistreerd bij de FIU.

Wat betekent dit voor de Indiase cryptomarkt? Volgens Raj Kapoor, oprichter van de India Blockchain Alliance, zal de heropening van buitenlandse crypto-exchanges de Indiase markt flink opschudden. De concurrentie zal toenemen, wat voor beleggers kan zorgen voor betere handelsvoorwaarden, lagere kosten en meer keuze. Dit kan ook leiden tot een hogere liquiditeit, waardoor de Indiase cryptomarkt aantrekkelijker wordt voor grote investeerders.
Maar Kapoor waarschuwt dat binnenlandse exchanges hierdoor onder druk komen te staan om hun diensten te verbeteren. Dit kan leiden tot extra regels en uitdagingen voor de sector, omdat toezichthouders willen zorgen voor naleving van de regelgeving en de bescherming van investeerders.
Nieuwe regelgeving in aantocht India is ook bezig met het opstellen van nieuwe cryptowetgeving. Het ministerie van Economische Zaken werkt aan een consultatiedocument dat in oktober wordt verwacht. Dit document zal input vragen van verschillende partijen, van experts tot bedrijven en het grote publiek. De overheid lijkt een serieuze rol te willen spelen in het vormgeven van de toekomst van digitale valuta’s in het land.
De verdere groei van de cryptosector in India hangt sterk af van ondersteunend beleid. Volgens Raj Karkara, COO van ZebPay, zorgt de overheid met deze aanpak voor transparantie en evenwichtige regelgeving die de sector verder kan laten ontwikkelen.
In april 2022 voerde India al belastingregels in voor cryptotransacties, waaronder 30% belasting op ongerealiseerde winsten en 1% bronbelasting op elke cryptotransactie. Tot nu toe heeft de regering zich echter vooral gericht op het bestrijden van witwassen en het financieren van terrorisme, zonder dat er concrete regels zijn voor de handel in crypto.
